(On the Use of Media Services at Webster University in Tashkent)

In accordance with this Offer, the Media Department of the Center for the Implementation of Educational Programs at Webster University in Tashkent grants permission to use its services in exchange for a membership fee. The "Student" undertakes to return the media rooms and equipment received for use in proper condition and within the specified timeframe.
This document constitutes an official Offer to individuals (hereinafter referred to as the "User") who are eligible to enter into a service agreement (hereinafter referred to as the "Agreement") for the use of paid services provided by the Media Department of the Center for the Implementation of Educational Programs at Webster University in Tashkent (hereinafter referred to as the "Center"), in accordance with Articles 367 and 369, Part 2 of the Civil Code of the Republic of Uzbekistan.
By performing the actions specified in this Offer, the User unconditionally accepts the terms outlined below (Acceptance of the Offer). The contract is considered concluded upon the User's acceptance of the Offer. In all matters not directly covered by this Agreement, the parties will comply with the legislation of the Republic of Uzbekistan and established business practices.
Before using the service, the User must read the full text of this Offer. If you fully or partially disagree with the terms of the Offer, you must refrain from using the service.
Processing of Personal Data – performing one or more actions related to the collection, systematization, storage, modification, supplementation, use, provision, distribution, transfer, anonymization, and destruction of personal data.
Personal Data – information provided by the user to access the service that relates to a specific individual or allows for their identification.
Services – the use of media equipment and media rooms (studio).
Spring Semester – from January to June.
Fall Semester – from August to December.
Usage Period – two working days.
3.1. The membership fee specified in paragraph 1 of this proposal amounts to 325,000 (three hundred twenty-five thousand) UZS for one semester.
3.2. The payment amount must be transferred in full to the Center’s bank account within 3 (three) days after the Offer is concluded, without delay. If the payment is not made within the specified period, the contract will be considered not to be concluded.
3.3. If a student intends to use equipment worth more than 91,000,000 (ninety-one million) UZS based on the total equipment cost, an additional payment of 1% (one percent) of the total cost of the extra equipment will be required.
4.1. The Center has the following rights:
4.1.1. To demand that the membership fee be paid by the Student in the amount, manner, and within the terms specified in sections 3.1, 3.2, and 3.3 of these Offers.
4.1.2. If equipment is lost or becomes unusable due to the Student's fault, the Center has the right to demand compensation for the damage either by replacing the equipment with an identical one or by paying its value to the Center’s bank account.
4.1.3. To organize the service in accordance with the policies and procedures of the Media Department of Webster University.
4.2. The Student has the following rights:
4.2.1. After paying the membership fee, the Student has the right to demand that the equipment provided by the Center be in a usable condition.
4.2.2. To pay the amount specified in section 2.1 of this Offer by transferring the payment to the Center's bank account.
4.2.3. To comply with the requirements outlined in the policies and procedures document of the Media Department of Webster University.
5.1. The Center is obliged to:
5.1.1. After the membership fee is paid, the Center is obliged to grant permission to use the Media Department and the equipment available there, located at Navoiy Street 13, Shaykhontohur District, Tashkent, for one academic semester.
5.1.2. In necessary cases, the Center is obliged to provide information about the Media Department and the equipment available there, as well as the conditions for using them.
5.2. The Student is obliged to:
5.2.1. To pay the amount and within the terms specified in sections 2.1 and 2.2 of this Offer.
5.2.2. To ensure that the used equipment of the Media Department is kept in good and functional condition and to return it to the Center in working order.
5.2.3. If the equipment from the Media Department is lost or becomes unusable, the Student is obliged to compensate for the damage either by replacing the equipment with an identical one or by paying its value as indicated in the primary documents (invoice, delivery note).
6.1. The Parties will be held liable for failure to fulfill the obligations under this Offer in accordance with the terms of the contract and applicable legal regulations.
6.2. The Parties will be released from liability for failure to partially or fully fulfill the obligations under this Offer due to exceptional circumstances.
7.1. Any disputes arising during the validity of this Offer will be resolved through negotiations between the Parties.
7.2. If an agreement is not reached in resolving the dispute, it will be settled by the court in accordance with the procedures established by law.
8.1. By accepting this Offer, the User confirms that they unconditionally accept all the terms of this contract and undertake to comply with them.
PRIVACY & POLICY OF THE MEDIA CENTER
Overview. We value the integration of theory and practice, and endeavors to prepare students for immediate work in their profession upon graduation. A component of that practice is exposure to and regular use of industry standard equipment and technology. The policies and procedures contained herein will help us get the equipment into the hands of the students who need it and keep that equipment in good working order and available to students when they need it.
Terms. The equipment and facilities managed by the Media Center are specifically designed to complete educational and professional projects for Webster. The remarkable level of facilities and access to facilities is part of Webster's curriculum and culture. However, this is not right and can be revoked in the case of egregious violations of the policy that endanger equipment or people or disrupt the orderly access of others to equipment and facilities.
Access to the equipment is free for students, staff and faculty of Webster University. There are no expenses related to the rental of equipment and premises, but fines may be charged to manage expenses related to the maintenance of equipment.
Access to equipment is associated with enrollment on certain courses, including regular courses and independent research. Students will not be allowed to inspect equipment they do not have access to without special permission. All special permits are issued by the teaching staff of the department and/or the school administration, and the request and permission must be made in writing. Special requests are not fulfilled automatically and may be rejected at the discretion of the faculty. FTVP students should familiarize themselves with the following to understand how access to equipment is related to enrollment in one of the three program meeting courses.
An individual student may not check out equipment worth more than $7000 at a time. If a project requires equipment worth more than $7000, students will have to create production teams, and several responsible parties will be required to check the equipment.
STUDENT RESPONSIBILITY
To ensure that properly functioning equipment can be distributed to the many students who will need it, we expect each student to follow some basic guidelines that include responsibility for the item, ownership of the item, and immediate reporting of any damage, loss or malfunction of the equipment. Also, if students lose or damage an equipment, they are expected to cover the cost of equipment as shown on the University's invoices.
Expectations:
Warning of punishment: in case of violation of one of the above rules, the student will be punished for his actions:
1st Infraction: Loss of equipment access for two weeks, meeting with the director of the media Center. 2nd Infraction: Loss of equipment access for a semester, meeting with the administration. This will go on the student record as a conduct violation.
3rd Infraction: permanent loss of equipment checkout from the Media Center. This will go on the student’s record as a conduct violation.
Failure to Report. It is the student’s responsibility to report damage or any sort of non-functional equipment to the Media Center immediately upon discovery or when they return the equipment at the end of the checkout period. Students failing to do so may incur penalties up to and including losing equipment checkout for a semester immediately upon discovery of the damaged equipment, at the discretion of the administration of Webster university in Tashkent.
Equipment Cleaning. Any equipment or equipment containers returned dirty (muddy, hairy, covered in tape, dusty, etc.) will receive a $5-$70 cleaning fee (depending on the severity of the condition) plus the following. If the dirtiness impacts the functioning of the equipment, the policy for damage will supersede this one. Remember when cleaning electronic equipment that you may not submerge it in water or get water into the sensitive electronics.

Term of Checkout. Most of the equipment is available within 24 hours; some types of checkouts may be longer. Check-out can be extended for up to 24 hours before the return deadline, provided that the equipment is not required for another booking.
Return. The equipment must be returned before the end time of the checkout by the person who checked it out. Late returns will incur the following penalties:
1st Infraction: Warning.
2nd Infraction: Loss of equipment checkout until student has a meeting with the director of the Media Center.
3rd Infraction: Meeting with the School of Communications administration. Mandatory loss of equipment checkout for two weeks. This will go on the student record as a conduct violation.
4th Infraction: Loss of equipment checkout for a semester. This will go on the student record as a conduct violation.
Attention: Fine 3% of the cost of all equipment per day after first Warning.
Facilities
Student responsibility.
The student using the facility acknowledges that the facility was in good working order during the period of use and assumes full responsibility for damage and/or losses incurred because of their use, including by those who work with the student who reserved the facility. If there are people who behave in a dangerous, destructive way or who could potentially harm the facility or the people working on it, ask them to leave, and if they don't, call the public security service. Students will return the facility to the “ready” state upon completion of use and report any problems, disorder, or equipment failure to a Media Center representative. The Media Center and Webster university are not responsible for personal items left in classrooms or laboratories. The injured party is responsible for any injuries resulting from the use of the premises.
Expectations:
Attention: Students are required to maintain cleanliness while using the facilities.
Term of Checkout
Most facilities are available for 4 hours; some are available for longer terms. Reservations can be extended for up to 4 hours, providing the facility is not needed for another reservation.
